These Terms of Use (“Terms”) govern your access to and use of https://www.superdesign.space and any related pages, products, templates, and services (collectively, the “Site” and “Services”) operated by Superdesign (“SuperDesign,” “we,” “us,” “our”).
By accessing the Site or purchasing/using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.
1. Definitions
- "Client Materials" means any content you provide (logos, copy, brand assets, data, etc.).
- "Services" means design, motion, consulting, branding, marketing, and other digital services provided by the Company.
- "Client" or "you" means any individual or entity accessing or using the Websites or Services.
- "Content" means all text, graphics, images, videos, software, code, designs, and other materials made available on or through the Websites or Services.
- "Deliverables" means design files, assets, or outputs created for you under a written agreement or subscription scope.
2. Eligibility & Account Responsibility
You must be able to form a binding contract in your jurisdiction. If you use Services on behalf of a company, you confirm you have authority to bind that company. You are responsible for maintaining the confidentiality of any login credentials and for activity under your account.
3. Changes to the Site or Terms
We may update the Site, Services, or these Terms at any time. Updated Terms are effective when posted. Continued use means acceptance.
4. Purchases, Subscriptions & Billing
If you subscribe to Services, you agree to pay the fees shown at checkout or invoiced to you, plus applicable taxes. We may use third-party payment processors; your payments may also be governed by their terms.
5. Refunds & Cancellations
Subscription scope (if applicable): Any turnaround times, queue rules, revision policies, and what counts as a “request” should be described on the Site and/or in a statement of work (“SOW”). If there is a conflict between these Terms and an SOW, the SOW controls.
Unless required by law or expressly stated in writing:
- Subscription fees are non-refundable for the current billing period once work has started. You may cancel future renewals according to your account or written agreement.
6. Intellectual Property
We (or our licensors) own the Site and all content on it, including brand elements, UI, and Templates, unless otherwise stated.
Client Deliverables: Ownership of Deliverables created specifically for you is defined by your SOW/subscription terms. Until full payment is received, we retain ownership of Deliverables to the maximum extent permitted by law.
7. Client Materials
You retain ownership of Client Materials. You grant us a limited license to use Client Materials solely to provide the Services. You confirm you have all necessary rights to provide them.
8. Acceptable Use
You agree not to:
- misuse the Site (scraping, hacking, interfering, bypassing access controls)
- violate laws or third-party rights
- upload malicious code or abusive content
- misrepresent affiliation with SuperDesign
9. Third-Party Links & Tools
The Site may link to third-party websites/tools (e.g., scheduling, analytics, payment providers). We are not responsible for third-party content or practices.
10. Disclaimers
The Site and Services are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or specific commercial outcomes (traffic, rankings, revenue), unless explicitly agreed in writing.
11. Limitation of Liability
To the maximum extent permitted by law, SuperDesign will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/revenue/data. Our total liability for any claim will not exceed the amount you paid to SuperDesign in the [last 1–3 months / last order] preceding the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold SuperDesign harmless from claims arising out of your misuse of the Site/Services, your Client Materials, or your breach of these Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Dubai, UAE , without regard to conflict-of-law rules. Any disputes will be resolved in the courts of UAE, unless the parties agree to arbitration in writing.
